Price Match Promise

We really want your business, so our prices are always keen but if you find the same product (total package including postage and packing) cheaper at the time of purchase we will always try to match the price or even beat it.

To take advantage of our price match promise: Just go to the contact us page. Enter as many of the details as possible so that we can validate your request. Price matches are subject to the following criteria:

  1. that the price match is against a company registered in the UK
  2. that the product is in stock
  3. that delivery times and payment terms are the same
  4. that the price match request is submitted and agreed by us prior to ordering
  5. that the price match request is not against an auction site, including 'buy now' sales on an auction site
  6. that the price match does not include a "special offer discount" and is not against an end of line reduction

Ordering

An order is deemed to be placed when either:

  • An order is placed electronically through this web site

  • An order is received, which includes full payment by a prescribed method, at our postal address: Action Replay, 1, The Laurels, Basingstoke, Hants., United Kingdom.

  • An order is placed directly through our call centre on + 44 (0)1256 639921. We aim to give the most accurate and up to date information available when taking telephone orders, however we cannot guarantee and be held responsible for any claim resulting from the accuracy of the information supplied. Product specifications may change without prior notice.

Orders are not accepted from persons under the age of 18 and by placing an order you represent that you are over 18. However, we welcome guardians buying products on behalf of under 18's.

Please contact us if you do not receive an e-mail acknowledgement of your order within 24 hours of placing it.

Guarantee

Care has been taken to portray and describe goods correctly and accurately, but slight variations in actual goods supplied can occur. If you are not entirely satisfied with your purchase, you may return it within 7 days of the date of dispatch, with your receipt, providing it is still in its original packaging and new and unused condition. We regret this guarantee does not apply to software or CDs. As with all companies, opened software is non-refundable, unless it is found to be unreadable.

Your right to reject goods

You are entitled to reject any goods delivered if such goods:

  • Are unfit for their purpose as held out by us at the time the order was placed; or

  • do not match their description as set out on the website;provided always that the goods are returned to us within 7 days of delivery by Royal Mail registered post or recorded delivery in a new and unused condition, in the original packaging together with a copy of the receipt.

Where the goods are returned according to the procedure set out in this paragraph, we will provide an exchange or refund any payment made to us less postage and packing and 25% restocking fee within 30 days of the receipt of the returned goods. Your right to cancel orders

Please note that you have a legal right to terminate your contract within 7 days of the date of receipt of the goods. Should you choose to exercise this right you will be reimbursed with any payment made to us less postage and packing and 25% restocking fee in respect of the order within 30 days beginning with the day on which the notice of cancellation was given. The goods must be returned to us within 7 days of delivery by Royal Mail registered post or recorded delivery in a new and unused condition, in the original packaging together with a copy of the receipt. Any goods received by you in respect of this order should be returned to us, packed securely with the advice note, to The Returns Department, Action Replay, 1, The Laurels, Basingstoke, Hants. RG21 4JP

Note: The 7 day cancellation period does not apply in respect of audio or video recordings or computer software which is opened by the consumer.

Returns Procedure

Subject to the guarantee set out above,

  • shipping costs of any returned goods remain the responsibility of the purchaser.

  • Returned goods are the responsibility of the customer until they reach us, as we cannot be held responsible for goods lost in transit. All goods must be returned in original packaging.

Lost or Damaged Goods

In the unlikely event that your product is lost or damaged in transit, please contact us in writing or by e-mail. In the case of non-delivery, please wait for up to 7 days from the date of your order in case it has been delayed. In the case of damage please contact us within 7 days of receipt and return the product to The Returns Department, Action Replay, 1, The Laurels, Basingstoke, Hants. RG21 4J, United Kingdom. Your postage cost will be reimbursed.

Payment Options

The prices of the goods are as dated on this website and are inclusive of any applicable value added tax. Payment shall be made at the time the order is placed. Payment may be made online by Paypal and Nochex. Due to an unprecedented amount of attempted credit card fraud both over the internet and over the phone we reserve the right to reject credit card payments in cardholder not present transactions.

Payment may also be made by cheque in Pounds Sterling drawn on a British Bank or by Eurocheque made out in Pounds Sterling both made out to Action Replay.

All prices quoted are in Pounds Sterling, and will be converted to your local currency by the credit card issuing authority at the rate applicable on the date of processing.

Delivery Times

We will provide written confirmation of the order usually within 24 hours (which are where the order is placed by e-mail or on-line form be deemed to include confirmation by e-mail and by placing an order by e-mail you confirm your acceptance of confirmation by e-mail) at the latest on the delivery of the goods. Dispatch of goods is normally within 24 hours of clearance of payment. Goods can take up to 5 working days for delivery in the U.K, 14 working days for delivery to any other E.C country, and up to 28 days to U.S. and/or Rest of the World. If your order is not received within these timescales, please call the store, and we will take action immediately.

Delivery Methods

Delivery is via The Royal Mail / Parcel Post, using First Class post or Special Delivery. In some cases, delivery will be via courier or registered post, e.g. for high value items to countries where the postal service is not reliable. Action Replay reserves the right not to supply to countries outside the U.K, where it is felt that the standard shipping costs will not cover the costs of heavier items. Smaller overseas orders will only be shipped at the customers risk. Items will only be delivered to the address registered with the payment method.

Undelivered Items

Items sent to the address specified by the customer that are subsequently returned as undeliverable by the Post Office or courier service will not be resent until the cost of the re-delivery is paid. It is the customers responsibility to ensure we have the full and correct delivery address.

Responsibility for Local Taxes and Duties

The purchaser is liable for payment of any local country import duty and/or sale tax levied at the time of entry into the country of destination.

Order Chasing Enquiries

Any order enquiries should be sent via e-mail to The Sales Department and attaching copy of the original order confirmation or the order ID code and the date order was placed.

Warranty Returns

Please obtain returns authorisation BEFORE sending goods. We may ask for it to be sent to an authorised repair agency.

  • Items will only be exchanged after we, or our authorised repair agents, have examined the faulty item and confirmed the fault.

  • Items found to have been modified or damaged by incorrect operation or mishandling will not be exchanged.

  • shipping costs of any returned goods remain the responsibility of the purchaser.

  • Returned goods are the responsibility of the customer until they reach us, as we cannot be held responsible for goods lost in transit. All goods must be returned in original packaging.

  • If the returned item if found to be working correctly then the item will be returned as soon as the purchaser makes payment covering the cost of shipment.

  • Items operated outside of the stated operating parameters will be considered outside of normal wear and tear and will not be replaced under warranty.

Security of Credit Card Details and Personal Data

In order to protect our customers and ourselves from online fraud we reserve the right to reject credit card payments over the internet or phone. After careful consideration we have decided to accept Paypal and Nochex. These are a much more secure system and you do not have to supply your credit card details to anyone if you don't want to.

Obviously we do not want to lose your business so email us at The Sales Department if you wish to pay be any other method.

Privacy Policy

At Action Replay we are committed to protecting your privacy. We only use the information we collect about you to process orders and to provide a more personalised shopping experience. The information we collect includes your name, address, phone number and e-mail address. This personal information will be held securely in accordance with the law, our internal security policy (accessible from the home page) and the Which? Web Trader Code.

We acknowledge our duties and obligations under the Data Protection Act 1998 and Which? Web Trader Code of Practice.

In placing an order you agree that we may use personal information obtained about you as a result of performance of the contract, for marketing purposes and to inform you of new products, goods and services provided from time to time. Any such information shall not be passed to third parties without your consent except in circumstances of insolvency, as a result of change of control of Action Replay or for the purposes of legal proceedings. We monitor customer traffic patterns and site usage to help us develop the design and layout of the store. Limitation of Liability

Your statutory rights are not affected by these terms and conditions. Subject as expressly provided in these terms and conditions, and except where the goods are sold to you when dealing as a customer (within the meaning of the Unfair Contract Terms Act 1977) warranties, conditions or other terms implied by statute or common law are excluded to the fullest extent permitted by law.

We reserve the right to modify or discontinue at any time the website without liability to you. Our Software Developers and Product Managers work extremely hard to ensure our website is as accurate as possible, however we cannot guarantee or be held responsible for any claim resulting from the accuracy of the information supplied. Pictures of products are for illustration only. Digital Map Products shall be delivered on an "as is" basis. Complaints

We will endeavour to deal with all complaints fairly, confidentially, effectively and speedily. We promise to acknowledge complaints within 5 working days and endeavour to keep you informed of the progress of any complaint and resolve such complaints within a reasonable time.

Any mistakes in bills, receipts or payments will be corrected within 30 days of agreeing to do so.

Any unresolved disputes may be referred to Which? Web Trader.

Miscellaneous

This agreement shall be governed by and construed in accordance with laws of England and Wales, without giving effect to any principles of conflicts of law, and any dispute arising out of this agreement shall be subject to the exclusive jurisdiction of the English Courts.

If any provision of this agreement is held to be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from this agreement and shall not affect the validity and enforceability of any remaining provisions.
